Terms of Service

Welcome to DayForm. These Terms of Service ("Terms") govern your access to and use of the DayForm mobile application ("App") and related services ("Services") provided by CodedRealities ("we", "us", or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the App, you confirm that you are at least 13 years of age and have the legal capacity to enter into these Terms. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Account Registration

To use DayForm, you must sign in with your Apple ID. You are responsible for maintaining the security of your account and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Free and Pro Plans

DayForm offers a free tier and a paid Pro subscription. The free tier includes full access to widget creation, daily tracking, calendar views, cloud sync, and the Widget Store. The Pro plan additionally supports media attachments (images, videos, audio, and files).

Pro subscriptions are billed through Stripe. Pricing, billing cycles, and renewal terms are displayed at the time of purchase. You may manage or cancel your subscription at any time through the subscription management portal accessible from the App's settings.

5. Cancellation and Refunds

You may cancel your Pro subscription at any time. Upon cancellation, your subscription will remain active until the end of the current billing period. No refunds or prorated credits are provided for partial billing periods.

When your Pro subscription ends, you will lose access to media attachments you uploaded while subscribed, including images, videos, audio recordings, and documents. These files will remain stored on our servers but will not be accessible to you unless you resubscribe. All other features of the App, including widget creation, daily tracking, calendar views, cloud sync, and the Widget Store, will continue to work normally on the free plan.

6. User Content

You retain ownership of all content you create in DayForm, including journal entries, media files, and widget templates. By publishing a widget template to the Widget Store, you grant CodedRealities a non-exclusive, worldwide, royalty-free license to display, distribute, and make that template available to other users.

You are solely responsible for the content you create and publish. You agree not to publish content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.

7. Widget Store

The Widget Store allows users to share and download widget templates. When you publish a template, other users may download and use it. If you unpublish a template, users who have already downloaded it will retain their copy. You may update your published templates at any time.

We reserve the right to remove any template from the Widget Store at our discretion, including templates that violate these Terms or that we determine to be inappropriate.

Your use of DayForm is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the App, you consent to the practices described in the Privacy Policy.

10. Intellectual Property

The App, including its design, code, branding, and all related materials, is the intellectual property of CodedRealities and is protected by applicable copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute any part of the App without our prior written consent.

11. Account Deletion

You may delete your account at any time through the App's settings. When you delete your account, all of your data will be permanently removed from our servers, including your profile, journal entries, media files, published templates, comments, and ratings. This action cannot be undone. Templates that other users have already downloaded will not be affected.

12. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the App will immediately cease.

13. Disclaimers

The App is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the App will be uninterrupted, error-free, or secure.

14. Limitation of Liability

To the fullest extent permitted by applicable law, CodedRealities and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or related to your use of the App, whether based on warranty, contract, tort, or any other legal theory.

15. Indemnification

You agree to indemnify, defend, and hold harmless CodedRealities and its affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the App, your content, or your violation of these Terms.

16. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the App or by other means. Your continued use of the App after such changes constitutes your acceptance of the updated Terms.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which CodedRealities operates, without regard to conflict of law principles.
